These Terms of Service (“Terms”) govern your use of https://flashsourcellc.com (the “Site”) and any purchase you make from Flash Source LLC (“Flash Source”, “we”, “us”), a limited liability company organized in New York. By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site or place an order.

1. Use of the Site

You may use the Site for lawful, personal shopping. You agree not to: use the Site in any way that breaks a law or regulation; try to gain unauthorised access to the Site, our systems or other users’ accounts; interfere with or disrupt the Site; use bots, scrapers or other automated tools to place orders or copy content in bulk; or submit false or misleading information. You must be at least 18 years old to place an order, or have the permission of a parent or guardian.

If you create an account you are responsible for keeping your login details confidential and for what happens under your account. Tell us promptly at info@flashsourcellc.com if you think someone else has used it.

2. Products and product information

We try to describe and show our products accurately, but we do not promise that descriptions, images, colours or other content on the Site are complete, current or error-free. Product images are for illustration, and packaging or presentation may vary from what is shown. Brand and product names that appear on the Site belong to their respective owners; we are not affiliated with or endorsed by those brand owners unless we say so. Please read the labels, directions and warnings that come with a product before you use it.

3. Placing an order and order acceptance

When you place an order you are making an offer to buy. The confirmation email we send after checkout tells you we have received your order; it is not our acceptance of it. We accept your order when we ship it (or otherwise tell you that it has been accepted). We reserve the right to refuse, limit or cancel any order, or any part of an order, before it ships, for reasons including: a product is out of stock or no longer available; a price or product description was wrong; we cannot verify your payment or delivery details; we suspect fraud or misuse; or the order breaks these Terms. If we cancel an order after you have paid, we will refund the amount you paid to your original payment method and let you know.

4. Pricing, payment and pricing errors

All prices are shown in US dollars. Any applicable taxes and any delivery charges are shown at checkout before you pay. Payment is taken through our payment provider, Stripe, using the payment methods offered at checkout; we do not see or store your full card number.

Despite our efforts, a price or description may occasionally be wrong (for example a typing or system error). If we discover an error in the price of a product you ordered, we may, at our choice, cancel the order and refund you in full, or contact you to ask whether you want to go ahead at the correct price. We are not required to supply a product at an incorrectly stated price, even after your order has been confirmed.

Coupon codes and promotions are subject to the conditions stated with them, may be limited (for example to certain delivery countries or a set period), and can be withdrawn at any time.

5. Delivery

Delivery times shown on the Site, at checkout or in our emails are estimates, not guarantees, and can be affected by carriers, weather and other events outside our control. An order with several items may arrive in more than one shipment. Please make sure the delivery address you give us is correct; we cannot be responsible for delays or loss caused by an incorrect or incomplete address.

6. Returns, refunds and privacy

Returns and refunds are handled under our Return & Refund Policy. How we collect and use your personal information is described in our Privacy Policy. Both form part of these Terms.

7. Reviews and content you send us

Reviews on the Site can be left by customers who have bought the product. When you post a review or send us other content you confirm that it is your own honest experience and does not break the law or anyone’s rights, and you give us a non-exclusive, royalty-free right to display it on the Site and in our marketing. We may remove content that is unlawful, abusive, spam, or that identifies another person; we do not remove a review because it is critical.

8. Intellectual property

The Site, including its design, logo, text, graphics and software, belongs to Flash Source LLC or its licensors and is protected by copyright, trademark and other laws. You may view and print pages for your own personal use. You may not copy, reproduce, republish, sell or create derivative works from the Site or its content without our written permission. Third-party names, logos and product images remain the property of their owners.

The Site may link to or rely on services run by others (for example Stripe for payments, and social media or messaging services). We do not control those services and are not responsible for their content or practices; their own terms and privacy policies apply.

10. Disclaimer of warranties

Except for anything the law says we cannot exclude, the Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement. We do not promise that the Site will be uninterrupted, secure or free of errors. Nothing in these Terms limits any right you have as a consumer that cannot be limited by law.

11. Limitation of liability

To the fullest extent permitted by law, Flash Source LLC and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising out of or in connection with your use of the Site or any product. Our total liability for any claim relating to an order or the Site will not exceed the amount you paid us for the order the claim relates to. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Governing law and disputes

These Terms and any dispute arising from them or from your use of the Site or your purchases are governed by the laws of the State of New York, without regard to its conflict-of-law rules. If you have a problem, please contact us first at info@flashsourcellc.com or (838) 988-3900 and give us a chance to put it right; most issues can be resolved this way, and we ask that both sides try in good faith to resolve a dispute informally for at least 30 days before starting formal proceedings. If it cannot be resolved, the state and federal courts located in the State of New York have jurisdiction, and you and we agree to submit to them, unless the law where you live gives you the right to bring a claim in your local courts.

13. Changes to these Terms

We may update these Terms from time to time. The date at the top shows when they were last changed. Changes apply to your use of the Site and to orders placed after the change is published; an order you have already placed is governed by the Terms in force when you placed it.

14. General

If any part of these Terms is found to be unenforceable, the rest stays in effect. If we do not enforce a right straight away, that does not mean we have given it up. We are not responsible for delay or failure caused by events beyond our reasonable control. These Terms, together with the Return & Refund Policy and Privacy Policy, are the whole agreement between you and us about the Site and your orders.
